Was Chessura ist

Dein Konto

Beim ersten Start bekommst du ein anonymes Konto. Dein Stand hängt dann an diesem Gerät.

Was du in Chessura darfst

Was du schreibst

The German version is the original. If this translation differs from it, you may rely on the version that is better for you.

What this is about

These terms govern how you use Chessura, meaning the app for iPhone, iPad and Android, the web app and this website. Your contract partner is Simon Ehmann, Münchner Straße 43, 82178 Puchheim, Germany, called “we” below.

With the promise at the end of the first launch you accept these terms and agree to keep the community rules. The rules are part of these terms. How we handle your data is set out in the privacy policy.

What Chessura is

Chessura is an app for learning and practising chess and for playing against bots and other people. The app is free. It is in a beta phase, so there can be errors and interruptions.

We may change or discontinue lessons, games, rewards and other features if there is a valid reason for it. Valid reasons are errors and security gaps, new technology, requirements of Apple and Google, laws and court rulings, protection against abuse, and a better way to learn or a fairer game. A change costs you nothing, and we tell you in the app what changes. If a change noticeably restricts your use, we tell you in good time beforehand. You can end the contract at any time free of charge.

We try to keep Chessura available at all times but cannot promise it. Maintenance, faults and things beyond our control can interrupt the app for a while. So that app and server calculate by the same rules, you may need to update the app before your progress is synchronised again.

Your account

On first launch you get an anonymous account. Your progress is then tied to this device. If you lose the device or delete the app, you can no longer reach an anonymous account. We delete anonymous accounts that nobody has used for a longer time (see the privacy policy). So secure your progress in your profile with Apple, with Google or with email and password.

Up to five players can play on one device, for example siblings on a tablet. Each player has a separate account with its own progress. The code in front of a player only protects against opening the wrong one on the device.

Keep your sign-in details secret and do not hand your account to others. You are responsible for what happens through your account as far as it is attributable to you.

Age and parents

If you are not yet 18, you may use Chessura only if your parents agree. On first launch we ask for your age group. Please answer honestly. Under the age of 13 you can take part in everything but cannot write messages of your own.

What you may do in Chessura

You may use the app personally and not commercially. The rules apply to how we treat each other. We have no tolerance for objectionable content or abusive behaviour. This includes in particular insults, hate, threats, sexual content, harassing others and trying to obtain other people's personal data.

Messages and names pass an automatic filter. Anyone can report other players, names and messages and can block others. A person reviews every report. In case of violations we may remove content, reset names, warn, stop someone from writing or suspend the whole account for a time and, for serious or repeated violations, delete the account. A mute or a suspension applies at once, because it protects others. You learn the reason and can appeal once in the app, and then we decide anew.

It is also not allowed

  • to disrupt or overload the app or the server or to bypass protective measures,
  • to use the app with modified software, scripts or automated access,
  • to copy or pass on the course, exercises, texts, figures, images or sounds, unless the law expressly allows it,
  • to sell accounts, progress or virtual goods or to trade them for money.

What you write

You are responsible for your player name, your messages and the name of your club. You grant us the right to store this content and show it to those it is meant for, as far as this is needed to run the app and for moderation.

Fair play

Chessura rates your strength and compares you with others. That only works if everyone plays for themselves.

  • In rated games, duels, correspondence games, the promotion match and the league's daily puzzle you must not use a chess engine or any other outside help. Only the help that the app itself offers at that point is allowed.
  • You must not create a second account to gain an advantage, for example to hand yourself wins or rewards or to get easier opponents.
  • You must not lose on purpose to push your rating down, and you must not arrange results.

Our server replays results and notices what looks unusual. Duels between accounts that use the same device earn no seals. In case of violations we may leave results unrated, take back rewards, correct ratings and suspend or delete the account.

Seals, chests and other virtual goods

In Chessura you can earn and collect virtual goods, for example seals, chests, figures, piece sets, boards, frames, experience points, levels and leagues. The following applies to them.

  • Virtual goods have no monetary value. They cannot be paid out in money and cannot be bought for money.
  • They belong to your account and are not transferable. The exception is features the app itself provides for this, such as giving duplicate pieces to club members.
  • You receive a simple right to use them inside the app, not ownership.
  • Chests contain random content. They can never be bought for money.
  • We may adjust values, prices and rewards to keep the game balanced, to fix errors or to prevent abuse.
  • If you delete your account, your virtual goods lapse.

Rights in the app

All rights in Chessura, the course, the exercises, texts, figures, images and sounds belong to us or our licensors. You receive the simple, non-transferable right to use the app within these terms. Open-source components are subject to their own licences. You find them in the app in your profile under “Legal”.

Liability

We are liable without limit for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act, under the General Data Protection Regulation and where we have given a guarantee.

For slight negligence we are liable only if we have breached an essential contractual duty. That is a duty whose fulfilment makes the performance of the contract possible in the first place and on which you may regularly rely. In that case liability is limited to the damage that was foreseeable when the contract was concluded and is typical for such a contract. Otherwise liability is excluded. These rules also apply when our legal representatives or those who act on our behalf are at fault.

Other players are themselves responsible for their content.

Ending and deleting

You can stop using Chessura at any time and delete your account in your profile. How this works without the app is described under Delete account.

We can suspend or delete your account for good cause, above all for serious or repeated violations of these terms or the rules. Without such a cause we can end the contract with 30 days' notice, for example if we discontinue Chessura. We announce that in the app.

Changes to these terms

Without your agreement we change these terms only for four reasons, namely when a law, a court ruling or an authority requires it, when Apple or Google require it for distributing the app, when a provision is invalid or a gap disturbs the contract, or when the change brings you only advantages. In that case we change only what the reason requires, show you the new version in the app at least 30 days beforehand and highlight what changes.

For every other change we ask you in the app. It applies only if you agree, and you can take your time until it is meant to apply. If you do not agree, the old version continues to apply to you, and we can end the contract with 30 days' notice.

Law and dispute resolution

German law applies. If you live as a consumer in another country, you additionally keep the protection of those provisions of your country from which a contract may not depart.

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.

Note for Apple devices

If you downloaded the app from the App Store, the following also applies. This contract is between you and us, not with Apple. Apple is not responsible for the app or its content and is not obliged to provide maintenance or support. You must address claims concerning the app to us. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
